What happened

The 2026 rules require the proceeds of a property sale to be transferred to a UAE bank account held by the person or persons named on the title deed. The Dubai Land Department Regulatory Council additionally requires strict consistency between passport data, the title deed and the bank account holder details. Enforcement of the escrow rules has also been reinforced, with developer access to funds tied to verified construction milestones.

What changes in practice

Proceeds can no longer be routed to an offshore account or to an account held by a third party. Minor discrepancies in personal data — a middle name recorded on one document but not another, or a different transliteration of the same name — are sufficient to hold up the transaction at closing.

Who it applies to

Owners of UAE property, with the highest exposure among non-resident owners who have never opened a local account, and among co-owners where the account arrangements do not mirror the title deed exactly.

The exposure

A sale blocked at closing, with the cost and delay that follows: renegotiation risk, extension fees and, where a purchase is contingent on the sale, a broken chain. Opening a UAE bank account under time pressure is materially harder than opening one in advance.

What to do now

Before listing a property, check that the name on the title deed matches the passport and the bank account exactly, character for character. Where no UAE account exists in the correct name, open one first — the account opening process, including due diligence, should be started well ahead of any expected sale. For co-owned property, confirm how proceeds will be split and that each named owner has a compliant account.
